Accessory Dwelling Units (ADUs) Ordinance Amendments

The Planning and Development Department is proposing to amend the County Land Use and Development Code (LUDC) (Case No. 16-00000-00014), the Montecito Land Use and Development Code (MLUDC) (Case No. 16-00000-00015), and Article II, the Coastal Zoning Ordinance (Article II) (Case No. 16-00000-00016) in response to recent revisions to Government Code Section 65852.2 regarding the permitting and regulating of accessory dwelling units (ADUs).

Project Updates

 

 

In 2017 and 2018, Planning and Development Department staff prepared proposed ADU ordinance amendments based on direction and comments from the Board of Supervisors, County Planning Commission, Montecito Planning Commission, and the public. Staff also prepared amendments to the Santa Barbara County Uniform Rules for Agricultural Preserves and Farmland Security Zones (Uniform Rules) to allow ADUs on lands subject to agricultural preserve contracts.

On August 14, 2018, the Board of Supervisors unanimously voted to adopt the proposed amendments. The LUDC, MLUDC, and Uniform Rules amendments will go into effect in the Inland Area on September 14, 2018. The Article II and Uniform Rules amendments will go into effect in the Coastal Zone once they have been certified by the California Coastal Commission.

On June 19th, 2018, the Planning and Development Department requested to set a hearing for August 14, 2018.

On August 14, 2018, the Board of Supervisors voted 5-0 to adopt the proposed LUDC, MLUDC, Article II amendments to revise existing development standards and permit procedures and implement State law regarding ADUs, and adopt the proposed Uniform Rules amendments to allow ADUs as compatible uses on agricultural preserve contracted lands.

On June 1, 2018 the County Agricultural Preserve Advisory Committee (APAC) provided staff with input on the proposed amendments to the County Uniform Rules that would allow ADUs on lands subject to Williamson Act or Farmland Security Zone contracts.

The County Planning Commission continued the January 31, 2018 hearing to March 28, 2018. On March 28, the County Planning Commission forwarded a recommendation to the Board of Supervisors regarding the proposed amendments to the County Land Use and Development Code and the Article II Coastal Zoning Ordinance.

On September 12, 2017, the County Board of Supervisors took no action on the proposed ordinance amendments to the County Land Use and Development Code and the Article II Coastal Zoning Ordinance, and directed staff to return to the Board at a future date with revised ordinances reflecting upcoming revisions in State law following review by the County and Montecito Planning Commissions.
