Cannabis Land Use Ordinance

Background

The Board of Supervisors has directed staff to develop comprehensive cannabis regulations for activities associated with the Medicinal and Adult Use Cannabis Regulation and Safety Act (MAUCRSA).

As part of this effort staff has initiated the environmental review process in accordance with the California Environmental Quality Act (CEQA). Below you will find the Notice of Preparation, Scoping Document, and the Proposed Draft Cannabis Land Use Ordinance.

Please note that the Proposed Draft Cannabis Land Use Ordinance is a broad, preliminary draft to begin the environmental review process and garner responses. This is not a final recommended ordinance nor has it been presented to the County's planning commissions or Board of Supervisors. No decisions have been made regarding what licenses will be allowed or in what zones they will be allowed. The tables included in the document that are similar in appearance to zoning ordinance tables are only presented as illustrative information that will aid in the environmental analysis.

California Environmental Quality Act

The County of Santa Barbara is the lead agency preparing the EIR with the purpose of informing decision-makers and the public regarding the potential environmental effects related to the Project in compliance with the CEQA. The Project would amend the Santa Barbara County Land Use and Development Code, Santa Barbara County Montecito Land Use and Development Code, and Santa Barbara County Coastal Zoning Ordinance to allow certain types of cannabis activities by zone district.

This environmental scoping document describes the Cannabis Land Use (CLU) Ordinance and licensing program and provides a preliminary review of the Project’s potential environmental impacts in accordance CEQA.  This scoping document, along with comments received, will assist the County of Santa Barbara in identifying environmental impacts that must be evaluated in the EIR. The EIR will evaluate the environmental impacts of anticipated activities resulting from the implementing proposed draft ordinance language for land use entitlements and licenses. Changes to the proposed draft language may be required based on results of the environmental review and decision-making phases of the Project.
