Short-term Rental (STR) Ordinance

The Board of Supervisors has directed the Long Range Planning Division of the Planning & Development Department to review and clarify provisions concerning the use of Short-term Rentals within the unincorporated areas of the County. The STR project could result in zoning ordinance changes regarding how and where STRs may or may not be permitted.

Final adoption of ordinances related to Short-Term Rentals and Homestays

 

On October 3, 2017, the Board of Supervisors adopted ordinances which included regulations to:
Allow STRs in certain Commercial zones;
Allow STRs in the STR-Coastal Zone Historic Overlay Zone;
Prohibit STRs in Residential Zones;
Prohibit STRs in AG-I and AG-II Zones;
Prohibit STRs in Mixed Use, Resource Protection, Industrial, and Certain Special Purpose Zones;

Allow 'Homestays' in AG-I and Residential Zones.
In addition, the Board added these requirements for Homestays:
Homestays cannot exceed three rooms, a person can only apply for one homestay license, homestays must have nuisance response plans, and a long-term tenant is someone who has a lease for at least 6 months.
The option of Farmstays in AG-II has been directed to be reviewed in the Agricultural Tiered Permit project, to be completed at a later date.

The grace period to operate STRs and transition to another allowed use is until September 30, 2018 for the Inland area of the County and no later than 90 days following the certification of the ordinance by the California Coastal Commission or within 333 days after the date the Board of Supervisors adopted this ordinance, which ever is later, for the Coastal Zone.

Permits for Homestays will be available at the beginning of 2018.

On June 6, 2017 Board of Supervisors directed staff to return to the Board as appropriate with revised Short Term Rental (STR) Ordinances that will provide for the following:

Allow STRs in Commercial I Mixed Use Zones;
Prohibit STRs in Residential Zones;
Prohibit STRs in AG-I Zones; and
Prohibit STRs in Resource Protection, Industrial, and Certain Special Purpose Zones.

Allow 'Farmstays' in AG-II Zones consistent with standards incorporated into the Gaviota
Coast Plan.

Allow 'Homestays' in AG-I and Residential Zones.

Return to the Board as appropriate with recommendations for the establishment of a Coastal Zone Historic Residential Overlay Zone where STRs would be allowed.

Both the County and the Montecito Planning Commissions have conducted hearings and receive public testimony on STRs.

Planning & Development requested the Planning Commissions’ direction to develop specific zoning ordinance amendments to the County Land Use and Development Code, Montecito Land Use and Development Code, and Coastal Zoning Ordinance for the use or prohibition of STRs within the unincorporated County.

Based on the Planning Commissions’ direction, Planning & Development will prepare draft ordinance language for both the County and Montecito Planning Commissions’ consideration at future hearing dates.
